Opening a dispensary in Rhode Island
Rhode Island's adult-use sales began December 1, 2022 through existing compassion centers. The state allows up to 24 new retail licenses across six geographic zones, but its first round was halted in 2026: a federal judge blocked the residency requirement in April, the legislature repealed it in June and voided the round, and the Commission reopened applications on August 7, 2026.
Applications for the restarted round are due November 23, 2026. Qualified applicants will be selected by lottery, with seats in each zone reserved for social equity applicants and worker-owned cooperatives.
The regulator and the law
The Cannabis Control Commission (CCC) licenses and regulates adult-use cannabis, supported by the state's Cannabis Office. The governing law is the Rhode Island Cannabis Act of 2022, amended in 2026 by H 8544.
License types
| License | What it covers |
|---|---|
| Adult-use retailer | Up to 24 licenses across six zones, no more than four per zone, with at least one for a social equity applicant and one for a worker-owned cooperative in each zone. |
| Hybrid retailer | Existing compassion centers selling to both medical patients and adults. |
| Cultivator and manufacturer | Supply-side licenses under CCC rules. |
How licenses are awarded and current windows
- The first round drew 97 applications by December 29, 2025.
- April 8, 2026: a federal judge blocked enforcement of the residency requirement, halting the rollout.
- June 10, 2026: H 8544 was signed, repealing the requirement that applicants be majority-owned by Rhode Island residents and voiding the prior round. Prior applicants received refunds.
- August 7, 2026: the Commission reopened the retail application portal.
- August 17, 2026: the federal injunction was lifted.
- November 23, 2026: all adult-use retail applications must be submitted.
Qualified applicants will be selected by lottery rather than merit scoring, with reserved seats in each zone. Check the CCC's site for the lottery date and any zoning documentation requirements for this round; in the prior round, applicants had to submit local zoning approvals.
Ownership and management agreement rules
- The Rhode Island residency ownership requirement was repealed in 2026.
- Retail seats are reserved for social equity applicants and worker-owned cooperatives in each zone, so ownership and control of those applicants must meet the CCC's definitions.
- Management and investment agreements should keep control with the licensee and be disclosed as the CCC requires. Confirm current rules with counsel.
Social equity program
Each of the six zones reserves at least one retail license for a social equity applicant and one for a worker-owned cooperative. Social equity eligibility follows the Cannabis Act and CCC rules, including ties to areas disproportionately impacted by cannabis enforcement.

Local approval steps
- Confirm the city or town did not opt out. Municipalities held opt-out referendums in November 2022.
- Confirm the site sits in the correct zone and meets local zoning.
- Obtain local zoning approval as the CCC requires for this round.
- After selection, complete the build and pass inspection before opening.
